Short answer: there is no appeal process for a refused LMIA. Neither ESDC nor any Canada.ca page publishes an appeal or reconsideration channel for a Labour Market Impact Assessment decision, and IRPR s.203 — the regulation the LMIA lives under — contains no recourse provision. What is actually left is fixing the specific requirement that failed and reapplying, or checking whether the role can be filled through a route that needs no LMIA at all.
What does not exist
- No appeal. ESDC's "After you apply" section for the Temporary Foreign Worker Program links only to refusal to process, employer compliance obligations, modification of a positive LMIA, voluntary disclosure, and the non-compliant employer list. Recourse is not among them.
- No published reconsideration channel. If a consultant offers to "file a reconsideration," ask which government page describes it. We could not find one.
- No fee refund. ESDC states plainly: "If you receive a negative LMIA, you won't be reimbursed the processing fee."
- Regional processing-centre inboxes are not a review channel. ESDC's processing-centre page states those addresses are for LMIA documents only, and that other inquiries will not be answered or forwarded.
- The Employer Contact Centre (1-800-367-5693) gives program information, not decision review.
First: is it a negative LMIA or a refusal to process?
These are different outcomes with different fixes. Read the letter carefully.
| Negative LMIA | Refusal to process | |
|---|---|---|
| Meaning | Assessed, then decided against | Never assessed |
| Processing fee | Not refunded | Not charged |
| Notice | Decision letter | Letter stating why it was not processed |
| Typical cause | Wage below prevailing, recruitment not met, business legitimacy not shown, labour dispute impact | Ineligible employer list, low-wage cap exceeded, low-wage position in a CMA at 6%+ unemployment, sex industry, LMIA revoked in the past 2 years for false information |
| What to fix | Documents, wage, advertising | Whether you can apply at all |
If you hit a refusal to process, better documents change nothing. Check the regional rule in the low-wage freeze guide.
Grounds ESDC states in mandatory terms
- Charging recruitment fees to the worker — "Failure to do so will result in a negative LMIA decision."
- Wage below the prevailing wage. Prevailing wage is the higher of the Job Bank median or the range you already pay employees in the same job, location, skills and experience.
- Adverse effect on a labour dispute.
- Business legitimacy not documented. Every employer must file documents showing the business and the job offer are legitimate.
- Transition plan missing — mandatory for high-wage positions, with reporting on prior commitments for repeat applicants.
- Recruitment not met — at least 3 activities including Job Bank plus 2 others, 8 consecutive weeks for low-wage and 4 for high-wage, within the 3 months before submission, at least one activity running until the decision, records kept 6 years. Details in the 2026 advertising rules.
- New employers who have not employed a foreign worker in the previous 6 years face an additional review.
What to do with the refusal letter
- Classify it — negative LMIA or refusal to process.
- Map each stated concern to the published requirement — wage, advertising venues and duration, legitimacy documents, transition plan.
- Separate fixable items from structural ones. Regional unemployment and cap limits cannot be documented away.
- Check LMIA-exempt routes. A candidate with intermediate French, for example, needs no LMIA at all under Francophone Mobility (C16).
- Decide when to refile. No waiting period is published. Refiling the same package usually produces the same outcome.
Refusal is not the same as non-compliance
Non-compliance is a separate track with penalties up to $100,000 per violation and $1 million per year, program bans, and publication on the non-compliant employer list. The process runs Notice of Preliminary Finding → 30 days to respond → Notice of Final Determination. Inspectors check 29 conditions; records must be kept 6 years.
ESDC reported on 9 July 2026 that between 1 April 2025 and 31 March 2026 it finalized 1,488 inspections, found 12% of inspected employers non-compliant, issued over $10.2 million in penalties, and banned 30 employers.
FAQ
How soon can we reapply after a refusal? No waiting period is published. The only time-based bar we could verify is that an LMIA revoked in the past 2 years for false, misleading or inaccurate information triggers a refusal to process on new applications.
Can we go to Federal Court? IRCC states that temporary residence refusals — work permit decisions — can be taken to the Federal Court by application for leave and judicial review. That statement is about IRCC permit decisions, not about the LMIA itself. We found no official page describing judicial review of an LMIA decision. This is a question for a Canadian lawyer.
Can we get the officer's reasoning? A refusal to process comes with a letter stating why. For a negative LMIA, start by mapping the file against each published requirement rather than assuming the letter lists everything.
